What is Obamacare?

Obamacare, also known as the Affordable Care Act, is a new law that will come into effect in 2014. It will require that everyone has some sort of health insurance. If you do not have health insurance, you will have an extra deduction from your income tax. You will need to put the serial number of your health insurance on your income tax form. If you do not, you will be taxed extra. The question still remains: is Obamacare unconstitutional?

A lot of word is going around that Obamacare may be unconstitutional. There is little debate in congress on whether this is unconstitutional or not. Many people claim that Obamacare is unconstitutional. They say it is taking away their liberty and freedom that America fought to win from the very beginning. But is it true? Is Obamacare unconstitutional?

The Peoples’ Reasoning

Many people say that Obamacare is the first of many defaults to come in the world. They claim that Obamacare is yet another part of the government going downhill. People argue that health insurance should be an option of the people. “It should be an option, so we’re objecting!” This is a rant that has been brought up by a crowd of petitioning people. They argue that the people should have the freedom to choose whether they want to invest in health insurance, and it should not be a requirement. Many people say that Obamacare is just going to put people farther and farther into debt, and it will not help them at all.

The peoples’ main argument is that Obamacare takes away their liberty. When America was first founded, the people declared “freedom and justice for all.” They believe that Obama is trying to take away our liberty. Many say he’s trying to steal our liberty by applying this new law to everybody. The people declare that health insurance should be optional, not a requirement. Under Obamacare, health insurance is a requirement for those that don’t want an extra tax.

Obama’s Reasoning

Obama argues that his reason for laying down this new law is to protect the people from serious illness and car accidents. He says that people should be ready for everything. It is not to anyone’s knowledge of when exactly a car accident will occur. When it happens, it is too late to get health insurance. You’re simply stuck with forking over the money to pay all of the bill yourself. This is quite expensive, especially without health insurance. Obama’s reasoning is protecting the people, even though many people object to this law.

Even Boy Scouts?

Some Boy Scout troops that are in favor of Obamacare are arguing in its favor. They are spreading the word that everybody should “be prepared.” As a matter of fact, “be prepared” is the scout motto. They are fighting and saying that everybody should be prepared for stuff because anything could happen. You never know what might happen, the Boy Scouts of America argue.

Is Obamacare Constitutional?

Many people declare that the new law requiring everybody to have health insurance is unconstitutional. Is Obamacare unconstitutional though? Despite common beliefs, the answer is no. It is perfectly constitutional. The reasoning for this is quite simple, to be honest. Article 1 Section 8 of the United States constitution states “The congress shall have the power to lay and collect taxes, duties, imposts, and excises to pay the debts and provide for the common defense and general welfare of the United States, but all duties, imposts, or excises shall be uniform throughout the United States.” This states that the United States government has the right to collect taxes based on what they need, which is exactly what Obamacare actually is. It is nothing more than a common tax that can be avoidable.
